Work related injuries are compensated using a table charting the percentage of disability. Workers may not bring suit against their employer unless special circumstances exist. In exchange, injured workers are entitled to compensation regardless of fault. Unlike a claim against someone other than the employer, compensation is permitted upon a showing that the injury is work related. There is no determination of fault needed to grant compensation.
Benefits including temporary wages and payment for medical treatment are permitted. Depending on the long term effects of the injury, a permanency award may be granted. Even if the employer is willing to pay temporary benefits. A claimant will need the advice of an attorney to determine the extent and nature of any permanency.
